These terms govern your use of WaHttp, a service provided by JahaSoft Ltd, a company registered in the United Kingdom. By creating an account or using the service, you agree to these terms. If you don't agree, don't use the service.
The service WaHttp provides an HTTP API for sending and receiving WhatsApp messages, along with a dashboard, webhooks, and related features. WaHttp connects through the WhatsApp Web protocol and is not the official WhatsApp Business API. We are not affiliated with, endorsed by, or sponsored by WhatsApp LLC or Meta Platforms, Inc.
Your account You must provide accurate information when you register and keep your credentials secure. You're responsible for all activity under your account and API keys. Tell us promptly at [email protected] if you suspect unauthorised use.
Acceptable use You agree not to use WaHttp to send spam, unsolicited bulk messages, or any content that is unlawful, fraudulent, harassing, or infringing. You agree to maintain proper opt-in from the people you message and to comply with WhatsApp's terms, applicable marketing and privacy laws, and any anti-spam regulations that apply to you. You may not use the service to break the law or to interfere with the service's operation or security. We may suspend or terminate accounts that breach this section.
A third party operates WhatsApp and account bans WhatsApp and enforces its own limits and policies, which can change without notice. Using any third-party tool with WhatsApp carries a risk that your number may be rate-limited or banned. Our Smart Queue and warm-up guidance are designed to reduce that risk, but we cannot guarantee against it, and we are not responsible for actions WhatsApp takes against your number.
Plans, billing, and refunds Paid plans are billed in advance on a monthly or yearly basis at the prices shown at checkout. Yearly plans are discounted as advertised. Fees are charged through our payment processor to the card on file; Enterprise customers may pay by bank transfer or invoice. Every paid plan includes a 14-day money-back guarantee: if you're not satisfied, contact support within 14 days of purchase for a full refund. Except as stated in that guarantee or as required by law, fees are non-refundable. We may change our prices, and will give reasonable notice before changes affect your next billing cycle.
Free trial The free trial gives you one session, full feature access, and up to 100 messages per day for 24 hours, with no card required. We may change or withdraw trial terms at any time.
Service availability We aim for high availability but do not guarantee the service will be uninterrupted or error-free, except where a separate SLA applies to your Enterprise plan. We may perform maintenance, update features, or modify the service, and will try to limit disruption.
Intellectual property We and our licensors own the WaHttp software, brand, and content. These terms don't transfer any of those rights to you beyond the limited right to use the service. You keep ownership of the content you send through the service.
Your responsibilities for content You are solely responsible for the messages you send and the data you process through WaHttp, including obtaining any consents required and complying with data protection law as the controller of your recipients' data.
Disclaimers The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these terms, including implied warranties of merchantability and fitness for a particular purpose.
Limitation of liability To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential losses, including lost profits, lost data, or business interruption, or for any WhatsApp account action taken against you. Our total liability for any claim arising from the service is limited to the amount you paid us in the [12] months before the claim. Nothing in these terms excludes liability that cannot be excluded by law.
Indemnity You agree to indemnify us against claims, losses, and costs arising from your misuse of the service, your content, or your breach of these terms or applicable law.
Suspension and termination You can cancel at any time from your dashboard. We may suspend or terminate your access if you breach these terms, fail to pay, or use the service in a way that risks harm to us or others. On termination, your right to use the service ends and we may delete your data in line with our Privacy Policy.
Changes to these terms We may update these terms from time to time. When we make material changes we'll update the date above and, where appropriate, notify you. Continuing to use the service after changes take effect means you accept the updated terms.
Governing law These terms are governed by the laws of [England and Wales], and the courts of [England and Wales] have exclusive jurisdiction, except where mandatory local law gives you other rights.
